Article 1 (Purpose and Status)

These Terms set out the detailed conditions governing the use of "Airy Talk" (the "Service"), provided by Out of Set Inc. (the "Company") through Airy.

These Terms are Service-Specific Terms under the Airy Terms of Service (the "General Terms") and apply together with the General Terms. Where these Terms and the General Terms conflict, these Terms shall prevail with respect to matters concerning the Service.

Article 2 (Definitions)

  1. Input: Lines, character or scenario settings, images, comments, or other material a User enters into or uploads to the Service.

  2. Output: Dialogue, narration, synthesized audio, or other results generated through the Service.

  3. Character: An AI conversation partner created by a User or provided by the Company.

  4. Scenario: A story that unfolds through scenes, narration, and dialogue among multiple Characters.

  5. Preset Voice: A pre-produced synthesized voice made available by the Company for voice playback.

  6. Credits: The unit of usage deducted upon use of the Service, consisting of:

    • Promotional Credits: Credits granted free of charge by the Company upon registration, through events, friend referrals, or otherwise.
    • Purchased Credits: Credits purchased by a User for a fee.
  7. Merchant of Record: Paddle.com Market Ltd. and its affiliates (collectively, "Paddle"), which act as the merchant of record on the Company's behalf with respect to paid top-ups, handling payment processing, tax matters, and invoicing.

Other terms used herein shall have the meanings set out in the General Terms.

Article 3 (Description of the Service)

  1. The Company provides features including conversations with Characters, Scenario play, creating, publishing, and sharing Characters and Scenarios, comments, voice playback, and checking and topping up Credits.
  2. Use without logging in may be offered for a limited number of times. Such use is identified by an identifier stored in the browser, and the Company does not guarantee that records of such use will be retained or recoverable in the same manner as records of use through an account. Login is required once the limit is exceeded.
  3. Beta features, conversation models, and the lineup of Preset Voices may change in accuracy or availability, and may be changed or discontinued at the Company's discretion.
  4. Output may contain content or pronunciation that differs from the settings or the User's expectations. Users should not use Output as-is where fact-checking is required or for important decisions.
  5. Output is generated by AI. The Company may indicate this within the Service, and where a User uses Output in a manner that could be mistaken for the statement of an actual person or an actual event, the User must disclose that it is AI-generated.
  6. Published Scenarios and Characters may be featured on the home screen or made available to others via share links.

Article 4 (Eligibility and Accounts)

  1. Members of the Service must be at least 18 years of age. This is a Service-specific condition with respect to the age requirement set out in Article 4 of the General Terms, and these Terms shall prevail.
  2. The Company may conduct age verification procedures where necessary, and may restrict registration or use where a User does not meet the requirement.
  3. Any action taken through an account is deemed the act of the User. A User who becomes aware of any unauthorized use of their account must notify the Company immediately.

Article 5 (Credits and Payment)

  1. Credits may be deducted when a User uses features designated by the Company (such as conversations and creating Characters or Scenarios). Deduction amounts, the number of free uses, and holding limits are as displayed in the Service.
  2. The Company may grant Promotional Credits upon registration, through events, friend referrals, or otherwise. Eligibility conditions, limits on the number of grants, and validity periods are as displayed in the Service, and the Company may change or end events and the referral program upon prior notice.
  3. Purchased Credits are sold as one-time purchases. A package may include bonus Credits in addition to the base Credits, and prices and package contents are as displayed on the checkout screen. The Company may change package contents upon prior notice; such changes do not affect Credits purchased before the change.
  4. Promotional Credits and Purchased Credits each have their own validity period, calculated from the date of grant or purchase. Validity periods are displayed in the Service and on the purchase confirmation screen, and Credits are forfeited upon expiration.
  5. Paid purchases are processed through Paddle. Paddle handles payment processing and invoicing; the User's payment method information is held and processed by Paddle, not the Company.
  6. Purchased Credits are added to the User's account immediately upon confirmation of payment, at which point provision of the Service commences. Withdrawal of purchases and refunds are governed by the separately posted Airy Talk Refund Policy.

Article 6 (Ownership of Content)

  1. Rights in Input that a User creates or uploads belong to the User. Users must hold all rights necessary for their Input.
  2. Users may use Output they receive through the Service to the extent permitted by applicable law and these Terms. The Company does not warrant the originality or accuracy of Output, or that it does not infringe third-party rights.
  3. When a User publishes or shares Characters, Scenarios, comments, or other content, other Users may view and play it within the Service. The User grants the Company a non-exclusive license as necessary to operate the Service and to store, display, and transmit such content and make it available to other Users. This license remains in effect for as long as the content is provided through the Service.
  4. Content that other Users enter into a published Character or Scenario constitutes the Input of those Users.
  5. The Company may process Input and Output to the extent necessary for generating and delivering Output, operating the Service, maintaining security, responding to errors, and improving Service quality. Except to the extent a User has published or shared it, the Company will not disclose Input or Output outside the Service without separate consent.
  6. Where a User separately consents, the Company may use Input and Output to improve AI performance. Consent and its withdrawal are governed by the account settings and the Privacy Policy.
  7. Rights in Preset Voices, the Service's interface and software, and official Characters and Scenarios provided by the Company belong to the Company. Users may use them only to the extent permitted within the Service, and may not resell or redistribute Preset Voices themselves, or extract any separate voice model from them.

Article 7 (Service-Specific Prohibited Conduct)

In addition to the prohibited conduct set out in Article 6 of the General Terms, Users may not:

  1. Enter, generate, publish, or distribute content that sexualizes children or adolescents;
  2. Engage in obscenity, impersonate actual persons or organizations, or use another person's likeness, voice, or copyrighted work without the rights holder's consent;
  3. Post another person's personal information in Characters, Scenarios, comments, or elsewhere;
  4. Misrepresent Output as statements made by an actual person or as events that actually occurred;
  5. Resell or redistribute Preset Voices outside the Service as an independent product, or extract any voice model or embedding from them;
  6. Create multiple accounts or repeatedly use guest access to circumvent free Credits, usage counts, or creation limits;
  7. Call the Service in bulk using automated means, or collect conversations or content without authorization.

Violations are subject to the measures set out in Articles 6 and 7 of the General Terms. The Company receives and reviews reports from Users, and may delete violating content or restrict its visibility or the use of the account.

Article 8 (Account Deletion and Data)

  1. Users may delete their account at any time. Users are responsible for saving anything they wish to keep before deletion.
  2. Once deletion is complete, conversation history, Characters and Scenarios the User created, and other activity data are deleted and cannot be recovered. Any remaining Credits are also forfeited. Information that must be retained under applicable law may be retained for the period prescribed.
  3. Content that was published will no longer be provided through the Service after account deletion or removal of the content.

Article 9 (Limitation of Liability)

  1. The Company shall not be liable for damages arising from causes set out in Article 8, Paragraph 1 of the General Terms, except where the Company is at fault.
  2. Unless otherwise specifically provided by applicable law, the Company shall not be liable for damages in connection with Services provided free of charge (including use with Promotional Credits or free uses).
  3. Where the Company is liable for damages in connection with paid Services, the Company shall not be liable for lost profits, loss of data, indirect damages, or special damages that the Company could not have foreseen. The Company's total liability shall be limited to the greater of the total amount actually paid by the User during the twelve (12) months preceding the date on which the damage occurred, or KRW 50,000.
  4. Paragraphs 1 through 3 do not apply to damages arising from the Company's willful misconduct or gross negligence, infringement of personal information, or death or bodily injury.
  5. Where the Company compensates a third party for damages caused by a User's willful misconduct, negligence, or breach of these Terms, the Company may seek indemnification from the User.

Article 10 (Miscellaneous)

  1. Matters not addressed in these Terms are governed by the General Terms, the Privacy Policy, and the Refund Policy.
  2. The amendment procedure for these Terms follows Article 3 of the General Terms.

Addendum

These Terms take effect on October 16, 2026.
