Article 1 (Purpose)
These Terms of Service (“Terms”) govern the rights and obligations between Out of Set Inc. (“Company”) and users regarding the use of the “Airy” platform (“Platform”) operated by the Company and the individual services provided through the Platform (“Services”).
Article 2 (Definitions)
- Platform: The entire service delivery environment operated by the Company under the name “Airy,” including its website, applications, APIs, SDKs, and any other means of access.
- Service: An individual product or feature provided by the Company through the Platform. The Company may add, modify, or discontinue Services.
- Service-Specific Terms: Separate terms applicable to a particular Service (including fees, feature-specific limitations, eligibility requirements, and prohibited conduct), which apply together with these Terms.
- Acceptable Use Policy: The Airy Acceptable Use Policy separately published by the Company, which sets out conduct prohibited when using the Services and the measures taken in the event of a violation, and which forms part of these Terms.
- User: A person who agrees to these Terms and any applicable Service-Specific Terms and uses a Service.
Article 3 (Effect and Amendment of Terms)
- A User is deemed to have agreed to these Terms upon registering for an account or beginning to use a Service.
- Where Service-Specific Terms, or individual notices regarding pricing plans or features, differ from these Terms, the Service-Specific Terms shall prevail with respect to matters concerning that Service. Matters not addressed in the Service-Specific Terms shall be governed by these Terms.
- Where the Company amends these Terms, it will provide notice at least 7 days before the effective date (or at least 30 days before the effective date for amendments unfavorable to Users). If a User continues to use a Service after the amended Terms take effect, the User is deemed to have agreed to the amended Terms. A User who does not agree may discontinue use before the effective date. This Article applies mutatis mutandis to amendments of Service-Specific Terms and the Acceptable Use Policy.
Article 4 (Eligibility and Accounts)
- Users of Services directed at consumers must be at least 14 years of age; minors require the consent of a legal guardian. Eligibility requirements for Services directed at businesses may be separately set out in the applicable Service-Specific Terms.
- Users must register with accurate information, and are responsible for any issues arising from false information.
- Users are responsible for managing their own account and authentication credentials (including passwords and API keys) and may not share them with others. Any action taken through a User’s account or credentials is deemed to be the act of that User.
- If a User becomes aware that their account or credentials have been used without authorization, they must notify the Company immediately. The Company may temporarily restrict use where necessary for security reasons.
Article 5 (Provision and Modification of Services)
- The Company may add, modify, or discontinue all or part of a Service as needed for business or technical reasons, and will provide advance notice of material changes.
- Beta or trial Services may change in accuracy or availability without prior notice.
- Upon the launch of a new Service, the Company will publish the Service-Specific Terms applicable to that Service in advance.
Article 6 (General User Obligations)
Users may not use the Platform or any Service for any of the following purposes:
- Violating applicable law, or committing, facilitating, or concealing a crime;
- Impersonating another person, creating the false impression that content originates from an actual person or organization, or engaging in fraud;
- Creating or disseminating sexually explicit content, or content that sexualizes or is harmful to minors;
- Infringing the copyright, trademark, right of publicity, personal information, or other third-party rights of another;
- Promoting violence, hatred, or harassment, or creating discriminatory content targeting a specific person or group;
- Impersonating an election, public official, or government authority;
- Sending unsolicited bulk communications, spam, or deceptive advertising;
- Distributing malicious code, circumventing security measures, or engaging in unauthorized crawling or reverse engineering;
- Using multiple accounts or credentials to circumvent usage limits, or unauthorized resale;
- Developing or using any application or software that interacts with a Service without the Company’s prior written authorization;
- Using the output of a Service, or content made available through a Service, to train, develop, or improve any AI, speech synthesis, speech recognition, language, or machine learning model (whether developed by the User or a third party), or providing such output or content to a third party for that purpose.
In addition to the above, Users must comply with the Acceptable Use Policy. Service-Specific Terms may set out additional prohibited conduct specific to that Service, supplementing the above.
In the event of a violation, the Company may take measures including deleting content, restricting features, or suspending or terminating an account, and may report serious violations to law enforcement. Specific enforcement standards and appeal procedures are set out in the Acceptable Use Policy.
Article 7 (Termination and Restriction of Use)
- A User may withdraw at any time, and should download any necessary data or output before doing so.
- If a User violates these Terms or applicable law, the Company may restrict use after providing notice, except that notice may be given after the fact where required to prevent urgent harm or as otherwise permitted by law.
- Following withdrawal, personal information and stored data will be handled in accordance with the Privacy Policy and the applicable Service-Specific Terms.
Article 8 (Limitation of Liability)
- The Company is not liable for service interruptions caused by circumstances beyond its reasonable control, such as natural disasters, network failures, hacking, or governmental action, but will provide reasonable notice of such circumstances where possible.
- The Company’s liability is not limited with respect to its own willful misconduct or gross negligence, breaches involving personal information, or damages involving loss of life or bodily injury. For other damages, the Company’s liability may be limited, to the extent permitted by law, to direct and ordinary damages, and specific limits on damages may be separately set out in the applicable Service-Specific Terms.
- Where a dispute with a third party arises from a User’s unlawful use of a Service or breach of these Terms, the User is responsible for resolving such dispute at their own expense and responsibility.
Article 9 (Notices and Miscellaneous)
- The Company may provide notice to Users through announcements, in-service notifications, or the User’s registered email address.
- If any provision of these Terms is held invalid, the remaining provisions shall continue in full force and effect.
- These Terms are governed by the laws of the Republic of Korea, and disputes shall be subject to the jurisdiction of the courts designated under the applicable civil procedure laws.
