Article 1 (Purpose and Status)

This Refund Policy sets out the refund criteria applicable to paid plans and credit purchases for the "Airy API" service (the "Service"), and applies together with the Airy Terms of Service and the Airy API Terms of Service.

Article 2 (Payment and Refund Processing Entity)

Payment for Service fees is processed through the merchant of record, being Paddle or Polar, whichever is shown on the checkout page and receipt for the relevant payment (the "Merchant of Record"), and refunds are also generally processed through the Merchant of Record for that payment. Users may request a refund by contacting customer service (help@airy.so); the Company will determine whether the request qualifies for a refund under this Policy and, if so, will proceed with the refund through the Merchant of Record for that payment.

Article 3 (Refund Principles for Subscription Fees)

  1. Because use of the Service under a paid plan begins immediately upon completion of payment for that billing cycle, monthly subscription fees are, as a general rule, not refundable except as set out in Paragraph 2 and Article 6.
  2. Notwithstanding the foregoing, if the User has not used any of the Included Credits granted for a given billing cycle (i.e., zero credits used) within 14 days of the date of payment for that cycle, the Company will refund the full payment amount for that cycle upon the User's request. In such case, the granted Included Credits are immediately forfeited and the subscription is cancelled together with the refund.
  3. The unused-credit refund under Paragraph 2 is determined independently for each billing cycle (each payment), and applies equally to resubscriptions and repeat payments for the same plan. However, payments arising from a plan change (upgrade or downgrade) are instead governed by Paragraph 5.
  4. If a User cancels a subscription, the User may continue to use the Service for the remainder of the period already paid for, and automatic billing ceases from the next billing date. Except as provided in Paragraph 2, no pro-rated refund is provided based on the cancellation date.
  5. Where a User upgrades to a higher-tier plan, the higher-tier plan fee may be charged at the time of the upgrade, and fees already paid for the lower-tier plan are not deducted from that amount. Refunds for each payment are determined on a per-payment basis in accordance with Paragraph 2. Where a User downgrades to a lower-tier plan, the change takes effect from the next billing cycle.

Article 4 (Refund Principles for Credits)

  1. Promotional Credits granted upon registration or otherwise separately granted by the Company, and Included Credits granted at each billing cycle under a paid plan, are not items of sale and are therefore not eligible for refund; unused amounts are automatically forfeited upon expiration of their validity period.
  2. Additional Credits purchased separately are a one-time purchase that is granted to, and immediately available in, the User's account upon purchase, and are therefore, as a general rule, not refundable except as set out in Paragraph 3 and Article 6.
  3. Notwithstanding the foregoing, if a User has not used any of the credits granted by a given purchase of Additional Credits (i.e., zero credits used) within 14 days of the date of that purchase, the Company will refund the payment amount for that purchase upon the User's request. In such case, the credits granted by that purchase are immediately forfeited.
  4. Whether credits from a given purchase are “unused” under Paragraph 3 is determined on a per-purchase basis. Where multiple credits exist in an account, credits are deducted in order of expiration, starting with those whose validity period expires earliest, regardless of credit type (Promotional Credits, Included Credits, or Additional Credits). Where credits have the same expiration time, they are deducted in the following order: (1) Promotional Credits, (2) Included Credits, and (3) Additional Credits; within the same type, credits granted earlier are deducted first. Whether the credits from a given purchase have been used is determined based on this deduction order, and if any portion of the credits from that purchase has been deducted, the purchase is not considered unused.
  5. Unused Additional Credits are forfeited upon expiration of their validity period, and no refund is provided on the basis of such expiration.

Article 5 (Notice Regarding Withdrawal of Subscription)

  1. The Service is a digital service for which credits are granted, and use via the API becomes immediately available, upon payment; provision of the Service accordingly begins at the moment the User completes payment.
  2. By proceeding with payment, the User acknowledges the foregoing and the commencement of provision of the Service, and agrees that the right of withdrawal under Article 17 of the Act on the Consumer Protection in Electronic Commerce and other applicable law may be restricted.
  3. Notwithstanding the foregoing, where applicable law recognizes a User's right to a refund (such as where provision of the Service has not commenced, or where the User is unable to normally use the Service due to the Company's fault), such law shall prevail.
  4. To protect Users, the Company provides a full refund where credits granted have not been used (zero credits used) within 14 days, under Article 3(2) (subscription fee) and Article 4(3) (additional credits) respectively. This is a policy voluntarily provided by the Company irrespective of whether a right of withdrawal is recognized under applicable law.
  5. Where the Merchant of Record processes a refund separately from this Policy, whether under its own policy or applicable law, the Company may recover the credits granted in connection with the relevant payment.

Article 6 (Exceptions Where a Refund Is Available)

In the following cases, a refund may be provided within the scope permitted by applicable law and Company policy:

  1. Where, due to a material Service outage attributable to the Company, the User was unable to normally use the Service during a paid period;
  2. Where a payment error, such as a duplicate or mistaken charge, occurs through no fault of the User; or
  3. Where a refund is required under applicable law.

Article 7 (Grounds for Refund Restriction)

Refunds are restricted in the following cases:

  1. Where the Company has restricted use of the Service or terminated the agreement due to the User's breach of the Terms or fraudulent use;
  2. Credits that have already been used or that have expired; or
  3. Requests based on simple change of mind or non-use of the Service (other than as provided in Article 3(2), Article 4(3), and Article 6).

Article 8 (Refund Procedure and Processing Timeline)

  1. Refund requests are accepted by customer service (help@airy.so), and the Company will review whether the request qualifies for a refund and notify the User of the result within 5 business days of receipt.
  2. Where a refund is approved, the Company will instruct the Merchant of Record for the relevant payment to process the refund within 3 business days of approval. However, the actual time until funds are received may vary depending on the processing procedures of the Merchant of Record and the relevant payment method (e.g., card issuer).
  3. Where a User initiates a chargeback with their payment method issuer (e.g., card company) and the payment amount is recovered as a result, the Company may recover the credits granted in connection with the relevant payment or restrict use of the Service.

Article 9 (Enterprise Plan)

The Enterprise plan is subject to payment and refund terms set out in a separate agreement, which shall prevail over this Policy.
