Article 1 (Purpose and Status)
These Terms set out the detailed conditions governing the use of "Airy API" (the "Service"), provided by Out of Set Inc. (the "Company") through Airy.
These Terms are Service-Specific Terms under the Airy Terms of Service (the "General Terms") and apply together with the General Terms. Where these Terms and the General Terms conflict, these Terms shall prevail with respect to matters concerning the Service.
Article 2 (Definitions)
Input: Text, reference audio, or other material a User transmits to the Service via the API.
Output: Synthesized audio or other results generated by the Service.
API Key: Authentication credentials issued by the Company to a User to access the Service.
Preset Voice: A pre-produced synthesized voice made available by the Company through the Service.
Credits: The unit of usage deducted upon use of the Service, consisting of:
- Promotional Credits: Credits granted upon registration or otherwise separately granted by the Company.
- Included Credits: Credits granted to subscribers of a paid plan at each billing cycle.
- Additional Credits: Credits separately purchased by a User.
Merchant of Record: Paddle.com Market Ltd. and its affiliates (collectively, "Paddle") or Polar Software, Inc. and its affiliates (collectively, "Polar"), whichever is shown on the checkout page and receipt for each individual payment, acting as the merchant of record on the Company's behalf with respect to Service fees and handling payment processing, tax matters, invoicing, and related matters.
Other terms used herein shall have the meanings set out in the General Terms.
Article 3 (Description of the Service)
- The Company provides voice generation via API, a developer console, and usage/credit history features.
- Beta features and models may change in accuracy or availability without prior notice, and the composition of available models may be changed or discontinued at the Company's discretion.
- Output may differ from expectations in pronunciation or intonation; Users should review Output themselves before using it for important purposes.
- Where the Company offers a custom voice (voice cloning) feature, Users must disclose that Output is AI-generated where there is a risk that it could be mistaken for the statement of an actual person.
Article 4 (Eligibility and API Key Management)
- The Service is available to anyone seeking to use the API, including businesses and developers. However, individual Users must be at least 18 years of age. This is a Service-specific exception to the age requirement (14 years of age) set out in Article 4 of the General Terms, and these Terms shall prevail.
- The Company may verify a User's age through identity verification, adult verification, or similar procedures where necessary, and may restrict use where a User is found not to meet the age requirement.
- Users must manage their issued API Keys with the care of a good administrator and may not transfer, lend, or expose them to third parties. Any action taken using an API Key is deemed the act of the User.
- A User is responsible for damages arising from the leakage of an API Key unless the Company is notified without delay. The Company may temporarily restrict use of an API Key without prior notice where abnormal usage patterns are detected.
Article 5 (Plans, Credits, and Payment)
- The Company may grant Promotional Credits upon registration or otherwise. Included Credits are granted to paid-plan subscribers at each billing cycle; Included Credits are not granted to free-plan Users. Users may separately purchase Additional Credits as provided under their current plan. Specific fees, plan-specific Included Credits, and usage limits are set out on the Company's website, and the Company may change these, providing advance notice of any change.
- Promotional Credits, Included Credits, and Additional Credits each have their own validity period; unused amounts are forfeited upon expiration.
- Paid plans purchased on the website automatically renew and are charged monthly unless cancelled, and payments and renewals are processed through the Merchant of Record for that subscription. The Merchant of Record handles payment processing, taxes, invoices and receipts, and refunds; the User's payment method information is held and processed by that Merchant of Record, not the Company.
- The purchase agreement for Service fees (including fees for Additional Credits) is formed between the User and the applicable Merchant of Record, and the buyer terms of that Merchant of Record presented on the checkout page apply to that payment. The conditions of use of the Service, API usage, and Credits are governed by these Terms and the General Terms.
- Prices displayed on the website exclude taxes. The amount actually charged is the price plus taxes calculated by the Merchant of Record based on the billing address and other factors. Where taxes cannot be calculated, the Company may decline to proceed with the payment or plan change.
- If a User cancels a subscription, the User may continue to use the Service for the remainder of the period already paid for, and charges cease from the next billing date. Upon cancellation, unused Included Credits for that billing cycle are forfeited at the end of the cycle, while Additional Credits remain available for their respective validity periods.
- Matters concerning refunds are governed by the separately posted Airy API Refund Policy.
Article 6 (Account Deletion)
- Users may request account deletion through the console. Once deletion is complete, the account is deleted immediately and cannot be restored. Deleted items include API Keys, usage history, remaining Credits, and active subscriptions.
- Once deletion is complete, any active subscription ends immediately, and automatic renewal through the Merchant of Record is also cancelled. In this case, the remaining period under Article 5, Paragraph 6 does not apply, and all unused Credits are forfeited.
- If a User re-registers using the same login method as a deleted account, the sign-up bonus will not be granted again. If the deleted account had used a referral code, the referral bonus will not be granted again either.
- Accounts linked to an Enterprise agreement cannot be deleted through the console; the User must submit a separate request to the Company.
- Notwithstanding Paragraph 1, records that must be retained under applicable law or that are necessary for payment, tax, or dispute-handling purposes may be retained after account deletion to the extent set out in the Privacy Policy.
Article 7 (Ownership of Content)
- Ownership of Output generated or received by a User through the Service, and of any new content the User creates using such Output (collectively, "User Content"), belongs to the User. The User may use User Content commercially to the extent permitted by applicable law and these Terms.
- The Company may process a User's Input and Output to the extent necessary for generating and delivering Output, operating the Service, maintaining security, responding to errors or outages, and improving Service quality. The Company will not disclose Input or Output externally without separate consent.
- Where a User separately consents, the Company may use Input and User Content to improve the Service and to train AI models. Details regarding such consent and its withdrawal are set out in the Privacy Policy.
- The Company does not warrant the originality of Output or that it does not infringe third-party rights; Users are responsible for securing any necessary third-party rights, such as those relating to scripts or trademarks.
- Copyright in Preset Voices and other content the Company makes available through the Service belongs to the Company. Users may use such content only to the extent permitted by Service policy, and may not resell or redistribute Preset Voices themselves, or extract any separate voice model or embedding from them.
Article 8 (Service-Specific Prohibited Conduct)
In addition to the prohibited conduct set out in Article 6 of the General Terms, Users may not:
- Extract, or attempt to extract, model weights, parameters, architecture, or similar elements;
- Resell or redistribute Preset Voices outside the Service as an independent product or service, or extract any separate voice model or embedding from them;
- Circumvent, disable, or defeat technical limits or safeguards applied by the Company, such as rate limits, usage metering, or content filters;
- Place an excessive load on the Service, such as through abnormal bulk requests, or interfere with other Users' use of the Service;
- Remove or alter watermarks, metadata, or other markers inserted by the Company into Output to identify it as AI-generated;
- Provide as Input (such as reference audio), or clone, generate, or use, a voice that is not the User's own and for which the User has not obtained the explicit consent of the rights holder (including, in the case of a deceased person, the bereaved family or other legitimate rights holder);
- Use the voice of an election candidate or similar person to generate deepfake audio in a manner prohibited by the Public Official Election Act or other applicable law, or generate content that misleads voters about the date, time, place, or method of voting.
Notwithstanding Article 6, Item 10 of the General Terms, Users may develop and use applications or software that interact with the Service using their issued API Keys in accordance with these Terms.
Violations are subject to the measures set out in Articles 6 and 7 of the General Terms.
Article 9 (Limitation of Liability)
- The Company shall not be liable for damages arising from the causes set out in Article 8, Paragraph 1 of the General Terms; provided, however, that this shall not apply where the Company is at fault.
- Unless otherwise specifically provided by applicable law, the Company shall not be liable for damages relating to Services provided free of charge (including use of the Service with Promotional Credits).
- Where the Company is liable for damages in connection with a paid-plan subscription or a purchase of Additional Credits, the Company shall not be liable for loss of profits, loss of data or Credits, indirect damages, or special damages that the Company could not have foreseen. The Company's total liability shall be limited to the greater of (i) the amount actually paid by the User during the twelve (12) months preceding the date on which the damage occurred, or (ii) KRW 50,000.
- Paragraphs 1 through 3 shall not apply to damages arising from the Company's willful misconduct or gross negligence, infringement of personal information, or death or bodily injury.
- Where the Company has compensated a third party for damages arising from a User's willful misconduct, negligence, or breach of these Terms, the Company may seek reimbursement from the User.
Article 10 (Miscellaneous)
- Matters not addressed in these Terms are governed by the General Terms and the Privacy Policy.
- The amendment procedure for these Terms follows Article 3 of the General Terms.
Addendum
These Terms take effect on November 13, 2026.
